These Terms of Service govern your use of our website, online store, products and services. By visiting our website, creating an account, placing an order or purchasing a product from Vape Haven, you agree to these Terms of Service.

If you do not agree with these Terms, please do not use our website or purchase products from us.

Customers are responsible for using, charging, handling and storing vaping products correctly.

Electronic vaping devices, batteries, pods and accessories must be used only with compatible products.

You agree not to misuse, modify or operate products contrary to manufacturer instructions.

Batteries and electronic devices must be kept away from excessive heat, moisture, fire and other unsafe conditions.

Vaping products, e-liquids and nicotine-containing products must always be stored safely and kept out of reach of children and animals.

  1. ONLINE STORE TERMS

You may not use our products, website or services for any unlawful or unauthorised purpose.

You may not attempt to:

• Interfere with the operation or security of the website.

• Introduce viruses, malicious software or harmful code.

• Gain unauthorised access to our systems or customer information.

• Use false or fraudulent information when placing an order.

• Make purchases using payment details you are not authorised to use.

We reserve the right to refuse service or cancel transactions where we reasonably suspect fraud, abuse or unlawful activity.

Adding an item to your cart does not reserve stock.

All prices are displayed in South African Rand (ZAR), unless otherwise stated.

Prices displayed at checkout will apply to your order, subject to correction of genuine errors as permitted by applicable law.

Delivery charges, where applicable, will be displayed before you complete your purchase.

We reserve the right to change prices and promotions at any time. Changes will not ordinarily affect an order already accepted by us, except where required or permitted by law.

  1. ORDERS

Submitting an order does not necessarily mean that we have accepted it.

We may decline or cancel an order where reasonably necessary, including where:

• A product is unavailable.

• An incorrect price or product description was displayed.

• Payment is unsuccessful.

• Fraud or unauthorised activity is suspected.

• Age verification cannot be completed.

• Delivery cannot reasonably be completed to the address supplied.

If we cancel an order after receiving payment, the appropriate amount will be refunded using the original payment method wherever reasonably possible.

  1. PAYMENT

Payment must be completed using one of the payment methods available at checkout.

Customers are responsible for ensuring that all billing and payment information provided is complete and accurate.

Payment processing may be performed by third-party payment providers.

Vape Haven does not guarantee that every payment method will always be available.

  1. DELIVERY

We deliver to eligible locations within South Africa using our selected courier or delivery partners.

Customers must provide a complete and accurate delivery address, contact number and other information required to complete delivery.

Estimated delivery periods are estimates and may be affected by circumstances outside our reasonable control.

We will make reasonable efforts to process and dispatch orders promptly.

Vape Haven is not responsible for delays caused by incorrect customer information, unsuccessful delivery attempts or circumstances outside our reasonable control, subject always to your rights under applicable South African law.

Age or identity verification may be requested where applicable when an order is delivered.

  1. INCORRECT DELIVERY INFORMATION

Please check your delivery details carefully before completing your order.

If an order has not yet been dispatched, contact us immediately at business@adlmw.co.za if you need to correct your address.

Once an order has been dispatched, we cannot guarantee that the delivery address can be changed.

Additional courier costs resulting from incorrect information supplied by the customer may be charged to the customer where permitted by law.

  1. RETURNS, REFUNDS AND CANCELLATIONS

Returns, refunds and cancellations are subject to our Refund and Returns Policy and applicable South African consumer law.

Nothing in these Terms is intended to remove, restrict or replace any rights that you may have under the Consumer Protection Act, Electronic Communications and Transactions Act or other applicable legislation.

For health, hygiene and safety reasons, certain opened, used or unsealed vaping products, mouthpieces, pods, coils or e-liquids may not be eligible for a change-of-mind return where the law permits such a restriction.

This does not remove your statutory rights in relation to defective, unsafe, incorrectly supplied or otherwise non-compliant goods.

  1. DEFECTIVE PRODUCTS

We aim to supply products that are of acceptable quality and suitable for their intended purpose.

If a product is defective, please stop using it where continued use could be unsafe and contact us as soon as reasonably possible.

Defective products will be handled in accordance with applicable South African consumer protection legislation and any applicable manufacturer or supplier warranty.

Nothing in these Terms limits any warranty or remedy that cannot lawfully be excluded.

  1. PROMOTIONS AND DISCOUNT CODES

Promotions and discount codes may be subject to additional conditions communicated with the promotion.

Unless otherwise stated:

• Promotions are available while stocks last.

• Promotional codes cannot be exchanged for cash.

• A promotional code may be limited to one use per customer or order.

• Multiple promotional codes may not necessarily be combined.

We reserve the right to withdraw or correct a promotion where there is an obvious error, fraud or misuse, subject to applicable law.

We make reasonable efforts to keep the information on our website accurate and current.

Third-party product names, logos and trademarks remain the property of their respective owners.

Nothing on our website grants a customer ownership of any intellectual property belonging to Vape Haven, ADL-MW Trading (Pty) Ltd or a third party.

Our website may use services provided by third parties, including Shopify, payment processors, courier companies and other service providers.

  1. INDEMNITY

To the extent permitted by law, you agree to indemnify ADL-MW Trading (Pty) Ltd against losses or claims arising directly from your unlawful use of the website, fraudulent conduct or intentional violation of these Terms.

This clause does not require a consumer to indemnify us for matters for which we are legally responsible.

  1. CHANGES TO THESE TERMS

We may update these Terms of Service from time to time to reflect changes to our business, website, services or applicable law.

The latest version will be published on the Vape Haven website with an updated revision date.

Changes will apply from the date stated in the updated Terms and will not unlawfully remove rights already accrued under an existing transaction.

  1. SEVERABILITY

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue to apply to the extent permitted by law.

  1. NO WAIVER OF CONSUMER RIGHTS

Nothing contained in these Terms is intended to waive, exclude or restrict any statutory right or remedy that cannot legally be waived, excluded or restricted.

Where these Terms conflict with a mandatory provision of South African law, the applicable law will prevail.

Any dispute will be dealt with in accordance with applicable South African law and the consumer's rights to use any court, tribunal, ombud, regulator or other dispute-resolution mechanism available under applicable legislation are preserved.
